FAQ Demonstrative Evidence

Why would I use medical graphics?

Medical visuals bring your case to life where understated medical reports and dull clinical evaluations fail to inspire understanding or sympathy. Medical demonstrative aids act as a point of reference for discussion, ensuring a mutual understanding of the injury and its consequences, and prompting questions that can influence your final settlement

How much will it cost?

Cost is determined by the time required to illustrate a plaintiff’s unique injuries, with direct reference to their diagnostic imaging and medical reports. Focussing on key events and regions of interest keeps cost under control

Before proceeding, Harvey Visuals reviews available reports and provides a detailed quote, at no cost. The studio recognizes that there are caps on disbursements and makes every effort to deliver high-quality, reasonably priced resources that are admissible and useful for the lawyer. To add value, Harvey Visuals maintains a library of didactic anatomical exhibits to include alongside plaintiff-specific exhibits

____________

Here is an example of a demonstrative evidence proposal for a severe ankle injury:

  1. Functional anatomy of the ankle

  2. Date of Loss injury presentation

  3. Post-surgical view

  4. Degenerative changes on recent follow-up

  5. Impact of the injury on gait (as per clinical assessment)

Subtotal: ~$2,500 + HST

___________

This fee includes a PDF and—if needed—bound colour handouts. If jury boards are required, the cost for output and delivery applies, with a nominal fee for additional design work. For an animated sequence using illustrations created for the case, add ~$1,500-1,700 per minute

3D animation is billed at $85 per second

How long will it take?

Allow a minimum of two weeks for ‘still image’ demonstrative evidence prior to expert review, assuming that diagnostic imaging is already available and ready for transfer. Jury boards can be created and delivered with 72 hours’ notice, likewise with animation using existing illustrations

Can I wait for settlement to pay out?

Yes. Harvey Visuals will continue to bill at 2% quarterly interest until settlement. Please request an updated statement prior to settlement.

What type of injuries work best?

While any injury can be visualized, focus should be on injuries incurred on the date of loss and their direct consequences. While a pre-existing condition may be exacerbated by an accident, degenerative changes of the condition may not be successfully attributable to the accident.

Examples include:

  • Orthopaedic injuries especially through a joint where early onset of arthritis is predictable and joint degeneration, postural changes and / or difficulty with daily routines has been reported

  • Head injuries that appear to have healed but where behaviour has not improved and physiological deficiencies in the brain have been reported

  • Back and spinal injuries where spinal cord or peripheral nerve damage is suspected due to reported pain or neuropathy
